getting in hollywood. eyewitness news at 4:00 starts now. abrupt end. a mistrial in the roger clemens' perjury trial. >> what happened and how it's linked to maryland congressman elijah cummings. >> hi, everybody. i'm mary bubala. >> i'm kai jackson. here's what people are talking about. admissible evidence. a judge calls foul in the roger clemens' perjury trial today. a question asked by maryland congressman elijah cummings during a hearing is at the center of the mistrial. >> reporter: roger clemens signed autographs for fans after leaving the kraus in -- courthouse in washington, d.c. the judge issued a strike,

declaring a mistrial in clemens' perjury case, after the government revealed evidence, against his orders. the star is accused of lying to congress when he said he never used performance-enhancing drugs during his major league career. friday, they played conversation andy pettitte said he had a conversation with his wife. the judge had previously ruled that evidence off limits because he said it would prejudice a jury. >> proscooecutors-- prosecutors made a similar slip. but this time, the judge decided the damage had already been done and threw out the case. >> reporter: clemens and his lawyers remain under a gag order. they have to wait until september to find out whether there will be a new trial, and whether the former strikeout king will walk free. >> the judge set the hearing

for september 2nd. congressman cummings served on the house committee during the 2008 steroids hearing and is now its top democrat. wjz contacted him about today's development. but the congressman is not commenting. no freedom today for a man arrested in the fourth of july stabbing death at the inner harbor. vic has more. >> reporter: a judge denied bail for marcus harris today. harris is now facing second- degree murder in the death of 23-year-old joseph callo. harris turned himself in after seeing his picture on the news. he and callo were involved in an altercation in july. callo was from alabama and was visiting family over the weekend. >> all new at 5:00 and 6:00, for the first time, hear how the suspect, marcus harris, says the incident really unfolded. a 22-year-old in custody.

a mother and her baby are out of the hospital. wjz speaks to the mom who moved her baby. >> the mom had a bit of a cut on her forehead. but miraculously, she and her baby survived after jumping from a moving car on the capital beltway. >> reporter: surveillance video shows this after it was carjacked, with a mom and baby inside, it sideswiped an suv. police say terin alvin white was behind the wheel and took them on a dangerous, wild ride. he headed down i-95, and toward the capital beltway, at triple- digit speed, as the mother clutched her child. she called it the ride from hell, 40 miles. >> when i jumped out, i hit my head and rolled. and i guess i stood up. >> i asked him to pull over thousands of times. >> reporter: as the cash slowed -- car slowed, she sensed her chance, cradling her 20-month- old child, she jumped on the befltd way. >> he was going 110 at one

point. and i was thinking, if he is going 110 and hits anybody, we're going to flip. >> the mom said white cursed at and threatened her baby boy, named juju. >> i didn't know what to think. i put my seat belt on with this hand. and i pushed the door open. and used this leg first and jumped out. >> reporter: she also sideswiped a state trooper on the wild ride. white faces kidnapping and assault charges. >> when i saw the virginia trooper, 495. i was like, he's going to take me to west virginia, rape me and kill me and my son or something. i was so scared. >> reporter: reporting from edmondson avenue, where it all started, mike hellgren, wjz eyewitness news. >> and all new at 5:00, hear from witnesses who walked in horror as this all unfolded. and more on white's criminal background. charges dismissed.

maryland baltimore court rules a judge is right to dismiss bribery charges against city councilwoman helen holton. holton was accused of taking money from developers to pay for a poll during her 2007 campaign. wjz spoke with holton today about the court decision. >> there's a quote in the bible that weeping may endure for a night, but joy comes in the morning. so morning has come. and -- it's been hard. but it's also made me a better person. >> reporter: holton is running for re-election in november. >> we know the clock is ticking on the national debt limit. and there is more sniping than agreeing on capitol hill today. manuel gallegus reports, the squabbling is squawking dire warning from the financial world. >> reporter: lawmakers are pointing fingers, blaming each other for the debt stalemate.

>> republicans will not be reduced to being the tax collectors for the economy. and we won't let the white house fool around with the full face and credit of the united states. >> this was never about that for them. it's only been about protecting the wealthiest few, while middle class americans and our nations senator senior -- seniors pay the price. >> president obama called them back in for a fourth straight day. they're trying to raise a deal that would raise debt spending -- ceiling and cut spending. smiles didn't last at wednesday's meeting where tempers flared. at one point, president obama declared, "enough is enough" and demanded both sides find a fix by the end of the week. >> reporter: the federal reserve chair warns it will be a self-inflicted wound if lawmakers don't cut a deal. >> in almost every area where people have pocketbook concerns, jobs, interest rates,

credit, availability of government payments, benefits, all of those things would be affected in relatively short order. >> reporter: with the august 2nd deadline looming, moody's rating service warns it's putting america's bond rating under review for a down rating, if that happens, mortgage rates auto loans would go up. >> veterans and disabled americans would not receive their government checks if an agreement is not reached by august 3rd. we're enjoying comfortable temperatures. almost no humidity. wjz has weather and traffic together. meteorologist tim williams is here with the updated numbers from first warning weather. it's humid out there. didn't feel like it to me. >> no, the dew points have been very close. and that has always been the actual measure in the atmosphere. it is allowing for very nice,

cool dry air to move on in. the winds are coming in, pretty variable at just around 6 miles per hour. 40% relative humidity. 81 is the current temperature. dew points have been very, very low. they've been down in the 50- degree range for much of the day. which makes for a very high and comfortable day. high pressure in control is going to dominate the forecast for the next couple of days. how will that play into your weekend? we'll tell you. let's check in on the roads now with kristy breslin. wjz traffic control. the beltway already seeing some delays out there on the west side inner loop. those delays from wilkens avenue to liberty road. at this point, about 15 minutes to get through. another 15 minutes on the top side inner loop. that's from the jones falls expressway. north side inner loop, a crash there, also really beginning to back things up. northbound 95, heavy congestion there from 32 to 175. and other accidents include merit boulevard at german hill

a judge works on a multimillion-dollar compensation plan. the 2008 crash between a freight train and a passenger train killed 25 people. $4.2 million will go to each survivor of each killed. $1.2 million will be paid for each child who died. the company who hired the engineer agreed to the $200 million award. a houston couple is killed after an overnight fire rips through their home. neighbors called 911 after seeing flames shoot through at 4:00 a.m. after eventually extinguishing the fire, firefighters discovered a woman and her boyfriend dead. they say it appears the two were trying to escape but

couldn't get out in time. the fda releases new warnings about silicone breast implants. the warning includes complications some patients could face. andrea fujii has more on reaction from patients. research from the food and drug administration shows one in five women with silicone breast implants will need to have them removed within 10 years after surgery. dr. michael michael cohen of the cosmetic surgery center of maryland says women shouldn't panic. >> but that actually leaves 80% of women in that study being perfectly happy. >> reporter: the fda says complications including hardening around the implant, rupture or asymmetry. but the data does not indicate they cause cancer. she got them and knows she may have to replace them at some point. >> as personal as it is, it is just one of those things, where

you debate and weigh the risk. >> even though it's not intended to be lifetime, i think we can say with pretty much certainty, that they should last for a very, very long time. >> reporter: for feliz, the benefits outweigh any risks. >> have had no complications and have been very happy. >> reporter: so what should women with silicone implants do? the fda recommends getting routine mris to look for silent ruptures. and if they get any complications, see a doctor. >> and the fda recommends that women with silicone-gel-filled implants pay attention to changes and then follow up, as andrea said, with their doctor. not a great day on wall street. the markets have been falling most of the afternoon. the dow was down 54. the s&p down 8. the nasdaq lost 34. let's go to new york, where alexis christoforous has tonight's cbs money watch update.

stocks gave up an early gain, after federal reserve chairman ben bernanke dashed rounds of hope for a third economic stimulus. bernanke said the government is not ready to immediately pump more cash into the economy. fewer americans applied for unemployment last week. new applications fell from -- to 24,000 from 25,000. but there are still signs the labor remains weak. a group of private investors fell apart. borders will remain -- close its remaining 400 stores and go out of business if another buyer doesn't come forward. 11,000 people nationwide will lose their jobs if this whats. -- happens. spottify gives people access to more than 15 million

songs for free, as long as they listen to a few 15-second ads. subscribers can pay $5 a month to listen, ad-free or $10 for mobile devices. in new york, i'm alexis christoforous. karmagedon. it is the word many people in southern california are using to describe this weekend's complete shutdown of a major los angeles freeway. bill whittaker reports for wjz on why it's happening. >> reporter: this is how the 405 dubbed the nation's busiest freeway usually looks. 500,000 cars travel the 10 miles linking west los angeles to the highly populated san fernando valley. because this stretch is so heavily traveled, it needs to be widened. and to be widened, it needs to be completely shut down. >> even if we get the message out to half the people, that still means 250,000 people are going to try to use that road.

>> reporter: so from friday night to monday morning, traffic could be backed up as much as 64 miles. as thousands of commuters who rely on this freeway find other ways to get around. los angeles residents have a word for what is to come. carmageddon. even actor erik estrada is getting the word out. >> avoid the area. or just stay home. >> reporter: this doctor at a nearby ucla hospital knows where he'll be spending the weekend. >> i'm going to be staying in my office. i'm sleeping here. >> reporter: and the hospital support staff will also be roughing it, sleeping on cots on a nearby, not-yet-occupied medical office tower. >> i'll be staying here four days. it's going to be like a vacation. >> reporter: still, many are capitalizing on the expected catastrophe. >> we thought it was kind of fun to kind of poke fun at and maybe make a little money along the way. >> for just $4, jet blue says it will fly you right over the

air. 31 is your barometer. that's pretty steady. high pressure in control. we have 82 in cumberland. 77 down on the shore. and 83 in patuxent river. the magic number is 82 from columbia on over to rock hall. 81 from kent island to annapolis. and 84 down in d.c. the winds coming in with a bit of an ocean influence, keeping the temperatures a little cooler down in ocean city. 9-mile-per-hour winds coming in from the east. we do have a bit of a northeast wind around elkton. due north around the airport. and again, light winds around much of the rest of the state, coming in from different directions. but when we are starting to see these temperatures reflected, these cooler temperatures, we're starting to see the wind and the air coming in, from primarily the north and the northeast and northwest. , all of those temperatures are a little lower than ours. and that's what we have been dealing w. we have been watching the clockwise flow. and it's tapping into the nice, cool temperatures. and we'll eventually see another shift into the

it is 4:30. 82 degrees, clear and sunny. hellie, everyone. thanks for staying with eyewitness news. >> news corps investigation. a law enforcement investigation says the fbi is looking into allegations that media mogul rupert murdoch's newscorps tried to hack into the phone records of 9/11 victims. >> reporter: rupert and james murdoch say they will let british lawmakers grill them about the phone hacking scandal. the newscorps boss and his son first refused to testify but agreed after members of

parliament slapped them with court orders. lawmakers will also get to question news international chief rebecca brooks at the hearing on tuesday. the parliamentary panel is digging into allegations, reporters hacked the phones of murder and terror victims. they've already interrogated senior police officers, accused of taking money from journalists, sniffing for stories. >> reporter: british police are still sniffing for arrests in the hacking scandal. the latest arrest is a former deputy from news around the world. >> reporter: the latest scandal is showing signs of spreading to america. several are demanding an investigation into whether newscorps broke a u.s. law, banning bribes to u.s. foreign officials. they also want to know if families of 9/11 and other american victims may have had their phone hacked, too. >> there's no reason to believe, given what is going on in britain, that there aren't going to be similar episodes

going on here. >> murdoch is known as the dirty digger in the uk. now, the media billionaire is trying to dig himself out of the scandal that is front page news. in london, tina kraus, wjz eyewitness news. >> it is unclear whether rupert murdoch can be forced to appear since he is an american citizen. murdoch's son, james, has offered to speak to parliament next month. it has been more than a year since a deadly duck boat tour crash. now, the pilot of that boat is facing federal charges. kai is in the newsroom with the update on the investigation. >> reporter: the duck boat pilot is now charged with involuntary murder. sources say captain mike delvin was on his mobile phone dealing with a family emergency when the boat crashed. two tourists drowned. federal prosecutors say delvein has agreed to mead guilt --

plead guilty as part of a plea deal. >> investigators say the pilot received 21 phone calls during the moments before the crash. investigators say one person was killed and nearly two dozen more injured when the bus crashed into a rocky ravine. no word on what caused the privilege to collapse. former first lady betty ford is being laid to rest today in michigan. friends, family and politicians, gathered for a memorial service to honor the 93-year-old. >> reporter: betty ford came home to grand rapids for the last time. people lined the streets, asker casket made its way to h her second -- to her second and final funeral. >> amazing grace, how sweet the sound ♪ >> reporter: representatives from several white house administrations came to mourn the former first lady. former president bill clinton, escorted former first lady barbara bush. lynne cheney was a close friend from the time her husband was

president ford's chief of staff. >> betty ford had so many contributions to give to the world, so many contributions to make, so many lives she has changed for the better. >> reporter: mrs. ford was remembered for fearlessly confronting her breast cancer and her addiction. >> she became the face not of disease but of recovery. >> reporter: betty ford wanted the funeral to take place here at the same church where the fords were married 63 years ago. she is to be buried next to her husband on what would have been his 98th birthday. >> they loved holding hands. they loved lifting each other up. >> for me, the full circle is complete. you know? seeing my mom and my dad here together. you know, just at their home in grand rapids. >> reporter: two of ford's sons greeted the hundreding of people who file -- hundreds of people who filed past mrs. ford's casket to share with the rest of the country. >> we know she reached out to

the rest of the country with breast cancer and alcoholism and all of that, but to us, she was just "mom." >> reporter: in grand rapids, michigan, karen brown, wjz eyewitness news. >> today's service followed two days of public viewings. a manhunt continues now for the suspected mastermind of a kidnapping plot in west baltimore. monday night, police say two men abducted 8-year-old derek brown, as he walked along gwynn avenue. the boy was stashed in an abandoned house, while police say nathaniel booker used a cell phone to make a call to brown's family. however, rahim taylor, the alleged mastermind of the scheme is still at large. brown is now back with his family. 25-year-old katrina watts was holding her 3-year-old daughter, when another woman walked up and doused them with acid. 31-year-old tamara jackson is now charged with taking part in that attack.

takia anderson of greenbelt is also facing charges. both mother and daughter face serious burns, but they are alive. store a new charge to keep lead- tainted toys off shelves. >> reporter: the amount of lead allowed in toys sold in the u.s. will soon be reduced to one of the lowest limits in the world. in a very close vote, the consumer product safety commission cleared the way for the limit to be lowered next month on most products intended for children 12 and under. after it takes effect, all of those products must be 99.99% lead-free. critics, though, say the amount of allowable lead is already very low. and another reduction could pressure small businesses and even cost jobs. back to you, vic. >> exposure to lead can cause irreversible brain damage and learning disorders. talking about the weather. it doesn't get much better than

jessica tata, pleads not guilty to four counts of felony murder. prosecutors say the 23-year-old left seven children alone at her home-based day care, to go shopping when a boiling pot of oil caught fire last year. the fire left four of those children dead and three others injured. the victims' parents say they are seeking justice. >> elias, elizabeth, and kendall, seek justice. like i said. >> reporter: a judge is deciding to try tata individually for each death. the first of up to nine trials is set to begin in january. the dismembering of a 9- year-old boy has many people in a brooklyn neighborhood reeling. >> reporter: as the hearse carrying libi cletk i's body inside, there was a sea of silence. a boy who trusted a stranger and died because of it.

>> it's just a shock. simply a shock. nobody can believe it. >> his mother and sisters entered the temple first. then came libee. people there, stunned how he died. >> no one understands how this happened, why this happened. and you know, e -- why this brutal murder? >> reporter: the 8-year-old was spotted on surveillance camera, on his way home from day camp. then talking to the stranger who police say killed him and dismembered his body. >> i'm shocked. just to think that something like this could have happened here. >> reporter: tonight, the rabbi cried while speaking to the crowd in yiddish about the sacrifice this community had made, how what happened made no sense, and how libee's family needs support now more than ever. >> i'm sure they're playing things in their mind over and over again, what was the last thing i said to him, how many times did i kiss him?

>> reporter: aaron says he was hallucinating when he took the boy. a california case has garnered international attention. >> reporter: 48-year-old katherine cue appeared before a judge at an orange county courthouse. she is accused of drugging her estranged husband, tying him to a bed, then cutting his off, and throwing it down the garbage disposal. prosecutors say an argument over house guests led to that vicious attack. and cue's husband was rushed to a nearby hospital, where he is currently said to be in good condition. denise? >> thank you, monique. if convicted, cue could spend the rest of her life in prison. a new study suggests that some cosmetics could make it harder to lose weight. the health and beauty aids contain hormones. doctors say the daily use ofs

them, says dr. david feldman. >> we don't know a level of sulfite that may be safe or a level of sulfite that you won't have a sensitivity or reaction to. >> reporter: doctors say in some people, sulfites have triggered severe asthma attacks, but in recent years, sulfites are also being linked to a list in increased migraine headaches, heart palpitations, hives and joint pain. >> we need research on that, and/or hard data. >> reporter: nutritionist nicollette pace says while more cause and effect needs to be studied, she recommends erring on the side of caution when it comes to your diet. >> all in all, try to minimize the use of prepared foods. >> why am i having such a severe reaction to everything? >> cortez said she has no idea why they are being used in more and more processed foods, but that may explain why she isn't feeling well lately.

what a do you feel baive. big puffy clouds. >> the big difference between today and university -- >> dew point. >> it's the dew point. >> okay. >> humidity, yes. it changes from day to day. and changes from location to location. but dew point. when you talk about dew points being 25 to 30 degrees lower than the temperature. you are going to be comfortable. look at these temperatures now. just a great afternoon. 82. but the dew point is 55. now, yesterday, our dew points were around 70. that's a big difference. 39% humidity. north winds at 6. the barometer hassing. 30.01 inches. right now, it's beautiful in oakland, at 72. ocean city at 77. 84 up in elkton, wilmington

area. and easton. and over in washington. but it's dry everywhere. low 80s. some places never even get out of the upper 70s. a couple of spots north of the city, had 79 for their high this afternoon. some really comfortable. normal high is 87. by the weekend, our normal high goes up to 88, by the way. north winds for the most part, northeast winds. brought that new, dry, beautiful air mass into the region. this is the kind of weather you might expect up in new hampshire or maine, typically in the summer months. yes, it can get hot. but their average temperatures, like in caribou, the average high now is 79, 80 degrees. so it's pretty pleasant up there. this system on the east coast is bringing us this beautiful weather. the front that came through, the showers, way down to the south. you kind of see those clouds out there. still hot and humid. louisiana temps, near 100 degrees. high humidity, very uncomfortable. just a few high, thin clouds through the region. high pressure will give us a beautiful night tonight. very comfortably cool.

by late saturday, sunday, probably sunday. this high will move off. a little more humidity starts moving back, by sunday night, monday. i think you might feel the humidity. by monday and tuesday, definitely may be a risk of a thundershower here by tuesday. temperatures get back up close to 90s by monday. and again, low 90s, again, tuesday. south winds, 5 to 10 knots. tonight, then, look for clear, moonlight, 60 degrees. wow, what a beautiful night. tomorrow, sunny, nice. again, low humidity. tomorrow's high, only again in the low to mid-80s. right now, so far our highs today, only being 82 degrees. that is just fine with me. not too many compared to the temperatures in the low 90s. and humidity and dew points, much higher earlier in the week. it's a radical change. so enjoy it. >> we will enjoy it. keep it as long as we possibly can. >> couple more days. that's about it. >> we'll take it. >> it is a new july.
